Can I get my lost wages paid through workers compensation?

Hi, this is Lucas Foust from Foust Law Office and I'm here to answer a question that I receive on a regular basis. As a matter of fact, it's one of the four main questions that we received from people who have been injured at work. People come into my office or they call me on the phone and they asked me, can I get my lost wages paid?

Lucas Foust:

Well, yes. Under the Workers Compensation Act, if you were injured at work, you have a right to receive two-thirds of your average weekly wage and the two-thirds is less than you received before, but it's also, tax-free; no tax deductions can be taken out of the two-thirds to which you are entitled to receive.

Lucas Foust:

Again, they use the average weekly wage, so if there was a dip in your work a couple of weeks before, or the week before this, your workplace injury, you won't receive quite as much as you receive on average for the year, that can also be calculated as well.
