Hit By A Drunk Driver and You Do Not Have Insurance

Lucas Foust:

Hi, this is Lucas valves from Foust Law Office And I'm here to answer another quick question. And unfortunately this question I receive far too often as drunk driving really is an epidemic in our community here in Gallatin County. It happens every day and more often than you might think. People ask me, "Can I file a lawsuit if I was hit by a drunk driver, but I don't have car insurance." That's an excellent question. The short answer is absolutely, positively, yes, you may file a lawsuit or bring a claim against a drunk driver or any other negligent driver if you don't have insurance yourself. It's not held against you for making the poor decision of not obtaining insurance. Don't worry about it. If you've been in a car crash, even if you do not have insurance yourself, you have every right to bring a claim against another motorist who negligently causes injury to you.
