How much are my litigation costs?

Lucas Foust:

Hi, this is Lucas Foust from Foust Law Office, and I'm here to answer a quick question that I receive from people who are considering hiring me or hiring another attorney. The question I receive is what kind of litigation costs or legal costs can I expect over and above the legal fee that's part of the contingency fee agreement? Well, those costs are tough to figure at first and tough to determine, but one thing is certain, the longer a case goes on, the larger the litigation costs will likely be. If your case goes through the litigation process, you can expect to receive costs for depositions, which sometimes run four, five, six, and even $10 per page. Those depositions can run 100 to 200 pages.

Lucas Foust:

All litigation costs that are incurred are paid by our office before we ever take a fee. This is the standard in the industry, and this is what we do. So in other words, not only do we work for free before we receive funds for you, but we also pay the litigation costs upfront. It's difficult to determine exactly how much these litigation costs will be. To answer this question, and other questions that you might have in better detail, I recommend that you download our book, Abandoned on the Road: A Guide to Insurance in Montana. At Foust Law Office we believe that an informed is a better client.
