Hi, I'm Lucas Foust at Foust Law Office and I'm here to answer a quick question and this quick question involves a question that I receive very regularly from people who've been injured at work and want to file a workers compensation claim. They ask me, how much time do I have to file that claim?

Lucas Foust:

Well, the answer to that question depends on the type of claim that you're making. If you were injured in just one work shift or had a sudden or immediate injury that you realized, you have to notify your direct supervisor within 30 days, in order to file a workers compensation claim.

Lucas Foust:

If your injury took more than a single work shift, it may be characterized as an occupational disease and if that's the case, you have up to one year to file a claim and notify your employer of the industrial disease that you've realized from work.
