Should I file a lawsuit?
Hi, this is Lucas Foust from Foust Law Office and I'm here to answer another quick question, which again might not be so quick, but I'll provide a short answer for now. The question that I receive is, should I file suit?

One of the most difficult things that my clients have to deal with is the notion that they're sue-happy. People always come to me and say, "I'm not the type of person that sues." Unfortunately, insurance carriers, more likely than not, are going to require you to file a lawsuit to get an appropriate sum of money for you. You should not be embarrassed and you absolutely should not feel guilty about this. In the vast majority of cases, it's not the plaintiff attorney or the person who's representing the claimant that forces the litigation, it's the insurance company, and don't forget that. Please remember that. So should I file a suit? I recommend that you trust your attorney to make the right decision and determine when to file suit.
