Well, there are a lot of factors to consider before you decide you're going to settle your case. First and foremost, I believe you should have a very good understanding of exactly what your medical condition is before you begin the settlement discussion or settlement process. Montana law is very good in that it requires insurance companies, when liability is reasonably clear, to pay for medical bills and lost wages while your case is proceeding forward and without demanding a full and final settlement. As a result in Montana, and because of this very progressive and very thoughtful decision made by the Montana Supreme Court, you are in the catbird seat. You're in a strong position. The long and the short of it is you should settle your case when you fully understand the extent of your medical injuries and secondly, when you are fully able to do so on your terms, not the insurance company's terms.
